1. Introduction

These Terms and Conditions ("Terms") govern your use of the digital pilot logbook software and related services (the "Service") provided by Jamie Brooks, The One Nut Nightmare, and Metarauto.com ("I," "my," or "me"). By creating an account or using my Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service.

3. Description of Service

The Service is a cloud-based digital pilot logbook platform for recording, storing, and managing pilot flight data. I do not guarantee that the Service will meet your requirements or that it will be error-free, uninterrupted, or available at all times.

4. Account Registration and Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify me immediately of any unauthorized access to your account.
  • You are solely responsible for all activity under your account.

5. Data Storage and Backups

While I take reasonable measures to safeguard user data, Jamie Brooks, The One Nut Nightmare, and Metarauto.com are not responsible for any loss, corruption, or unauthorized access to your data, whether due to technical failure, human error, hacking, or any other cause. You are encouraged to maintain your own backups of all important information.

6. No Legal Verification of Records

Important Notice

The Service is intended as a personal flight record-keeping tool only. I do not verify, audit, certify, or otherwise confirm the accuracy or completeness of any information entered into the Service. The records you create or maintain within the Service are not official aviation logbook records and should not be relied upon to meet any legal, regulatory, or licensing requirements.

It is your responsibility to ensure compliance with all applicable aviation authority regulations, record-keeping standards, and certification processes.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to my systems.
  • Reverse engineer, modify, or distribute the Service without permission.

8. Intellectual Property

All software, content, trademarks, and materials provided by me are the property of Jamie Brooks, The One Nut Nightmare, and Metarauto.com, and are protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal or business logbook purposes only.

9. Payment and Usage

  • The Service operates on a pay-as-you-go, prepaid basis.
  • You must purchase usage credits before accessing certain features or continuing to use the Service.
  • All payments are non-refundable except where required by law.
  • Unused credits may expire after [insert expiry period if applicable].
  • Prices are subject to change at any time without prior notice; however, previously purchased credits will remain valid for their stated duration.

10. Limitation of Liability

To the maximum extent permitted by law:

  • I am not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of business opportunities, arising from your use of the Service.
  • My total liability to you will not exceed the total amount you have paid for usage credits in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Termination

I reserve the right to suspend or terminate your account without notice if you violate these Terms. Upon termination, your access to the Service will cease, and I may delete any associated data without liability.

13. Changes to the Service and Terms

I may update or modify the Service and these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts located in British Columbia.
